Welcome to Myqala! These Terms and Conditions ("Terms") govern your use of our website and the purchase of customized handmade portraits from Myqala . By accessing or using our website and placing an order, you agree to be bound by these Terms. Please read them carefully.

1. General Terms

These Terms constitute a legally binding agreement between you and Myqala. If you do not agree with any part of these Terms, you must not use our website or place an order.

2. Our Services

Myqala specializes in creating customized handmade portraits (colored or pencil) based on photos provided by you. Each portrait is a unique piece of art crafted to your specifications.

3. Ordering and Payment

3.1 Order Process

To place an order:

  1. Select your desired portrait options on our website and proceed to checkout.
  2. Make the full payment for your order.
  3. After your payment is confirmed, we will contact you via WhatsApp at the phone number you provided to request the photo you wish us to sketch.

3.2 Photo Submission Requirements

The quality of your custom portrait heavily depends on the quality of the photo you provide. Please ensure your photo meets the following criteria:

  • Non-Offensive Content: The photo must not contain any offensive, illegal, or inappropriate content.
  • Camera-Facing Subjects: Subjects in the photo should be clearly facing the camera.
  • HD Quality & Clarity: The photo must be in high-definition (HD) quality, not blurry. All contents of the picture, including facial features, must be clearly visible.
  • Close-Up or Selfie: We require close-up photos or selfies. Long-shot photos are not suitable.
  • Straight Photo: The photo should be straight and not taken at an awkward angle.

Myqala reserves the right to decline any photo submission that does not meet these requirements or is deemed inappropriate. In such cases, we will contact you to request an alternative photo or discuss other options.

3.3 Proofs and Revisions

Please note that Myqala does not provide digital proofs or previews of the sketch before shipping the final product.

3.4 Pricing and Payment

  • Full Payment: Full payment is required at the time of placing your order.
  • Accepted Payment Methods: We accept online payments and Cash on Delivery (COD) for eligible orders.
  • Taxes: All applicable taxes (e.g., GST) will be added to your order total at checkout.
  • Additional Charges: Prices may vary based on complexity, number of subjects, and specific material requests. Any such additional charges will be clearly communicated before final payment.

4. Shipping and Delivery

4.1 Production Time

Once we have received your suitable photo and payment, the estimated production time for your customized portrait is 4-5 days.

4.2 Shipping Time

  • Domestic (Within India): Estimated shipping time within India is 3-4 days after dispatch.
  • International: We offer international shipping. Please note that international orders will incur extra charges. Shipping times for international orders will vary based on destination and will be communicated at the time of order confirmation.

4.3 Courier Partner

We use Shiprocket for our shipping services.

4.4 Shipping Costs

All shipping costs (domestic and international) are to be borne by the customer.

4.5 Lost or Damaged Shipments

  • Lost Products: Myqala is not responsible for products lost during transit. We recommend ensuring your shipping address is accurate and secure.
  • Damaged Shipments: If your shipment arrives damaged, please refer to our Return and Refund Policy for instructions on reporting damage and potential solutions.

5. Returns and Refunds

Please refer to our dedicated Return and Refund Policy for detailed information on our return, refund, and cancellation procedures, especially concerning our 50% refund policy for customized products.

6. Intellectual Property (IP) and Your Content

6.1 Myqala's Artwork

The copyright of the final customized portrait created by Myqala remains with Myqala.

6.2 Use of Your Portrait for Promotion

By placing an order on our website, you provide us with your express consent to use the finished portraits for promotional purposes, including displaying them on our website, social media channels, and in our portfolio. We may showcase these artworks to demonstrate our work.

6.3 Your Responsibility for Provided Photos

You warrant that you have all necessary rights, licenses, consents, and permissions to provide us with the reference photos for sketching. Hey, if you're giving us a photo to sketch — you must be sure that you're allowed to use it. We're not responsible if you aren't. You agree to indemnify Myqala against any claims, damages, or expenses arising from your submission of photos that infringe on the intellectual property rights or privacy rights of any third party.

7. Limitation of Liability

Myqala strives to provide high-quality custom artwork. We will fix or refund the product if needed as per our Return & Refund Policy, but we’re not responsible for any emotional loss, missed gifts, ruined surprises, or any indirect, incidental, special, or consequential damages arising from the use or inability to use our products or services. Our total liability to you for any claim arising out of or relating to these Terms or your purchase will not exceed the amount you paid for the specific product in question.

Your privacy is important to us. Please review our separate Privacy Policy to understand how we collect, use, and protect your personal information.

9. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Haryana, India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Sonipat District, Haryana, India.

10. Changes to Terms and Conditions

Myqala reserves the right to modify or update these Terms and Conditions at any time. We will notify you of any significant changes by email, WhatsApp, or by posting the updated Terms on our website. Your continued use of our website and services after such modifications constitutes your acceptance of the updated Terms.
